End User License Agreement (EULA)

Applies to All Mobile Applications Published by Momentum Apps

This End User License Agreement ("EULA") is a legal agreement between you ("you," "your," or "User") and Momentum Apps ("Momentum Apps," "we," "us," or "our"). It governs your use of any and all mobile applications developed and distributed by Momentum Apps (collectively referred to as the "Apps").

By downloading, installing, or using any of our Apps, you acknowledge that you have read, understood, and agree to be bound by the terms of this EULA. If you do not agree to these terms, do not install or use the Apps.

1. License Grant

Subject to your compliance with this EULA, Momentum Apps grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Apps on a device that you own or control, solely for your personal and non-commercial use.

2. Ownership and Intellectual Property

All rights, title, and interest in and to the Apps, including but not limited to all source code, design, features, graphics, user interface, logos, and any accompanying documentation, are and will remain the exclusive property of Momentum Apps.

This EULA does not convey any ownership interest to you, and nothing herein shall be construed as a sale or transfer of any intellectual property rights.

3. Restrictions on Use

You agree not to:

  • Copy, reproduce, modify, translate, distribute, resell, or sublicense the Apps;

  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Apps, except as permitted by applicable law;

  • Circumvent, disable, or otherwise interfere with security or usage restrictions;

  • Use the Apps in any unlawful manner or for any illegal purpose;

  • Interfere with or disrupt the operation of the Apps or associated servers, networks, or infrastructure;

  • Attempt to gain unauthorized access to any portion of the Apps or related systems.

4. Updates and Modifications

Momentum Apps may, from time to time, provide updates, upgrades, bug fixes, patches, or other modifications ("Updates") to improve the performance or functionality of the Apps. You acknowledge and agree that such Updates may be automatically installed without providing additional notice.

We reserve the right to change, suspend, or discontinue any aspect of the Apps at any time, including the availability of any features, content, or functionality.

5. Privacy

Momentum Apps respects your privacy. We do not collect any personally identifiable information. However, we use Firebase Analytics, a third-party service provided by Google, to collect anonymous usage data to better understand how our Apps are used and to improve performance.

6. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from Momentum Apps if you fail to comply with any term of this Agreement.

Upon termination, you must cease all use of the Apps and delete all copies from your device.

7. Disclaimers

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APPS WILL BE ERROR-FREE OR CONTINUOUSLY AVAILABLE.

Momentum Apps does not guarantee that the Apps will meet your requirements or operate without interruption or error.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOMENTUM APPS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR OTHER PECUNIARY LOSS, ARISING OUT OF THE USE OR INABILITY TO USE THE APPS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the State of [Insert State], without regard to its conflict of law principles. Any disputes arising out of or relating to this EULA shall be subject to the exclusive jurisdiction of the courts located in [Insert Jurisdiction].

10. Severability

If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
